關於個人資料（私隱）條例的客戶通知

客戶在申請開戶口，延續戶口及建立或延續財務信貸便利或要求本公司提供金融服務時，需要不時向本公司提供有關資料。
若未能向本公司提供有關資料會導致本公司無法開立或延續信貸便利或提供金融服務。
在客戶與本公司的正常業務往來過程中，本公司亦會收集到客戶的資料。
有關客戶資料可能會應用於下列用途：
- 本公司提供金融服務和信貸便利給客戶之日常運作；
- 作信用檢查；
- 協助其他財務機構作信用檢查；
- 確保客戶的信用維持良好；
- 為客戶設計金融服務或有關產品；
- 推廣金融服務或有關的產品；
- 確定本公司對客戶或客戶對本公的債務；
- 向客戶及為客戶提供擔保或抵押的人仕追收欠款；
- 根據本公司須遵守的法例之要求作出披露；及
- 與上述有關的用途。
在法例許可下本公司會把客戶的資料保密，但本公司可能把有關資料給予下列組織/機構在香港以外地區的組織/機構：
- 提供與本公司業務運作上有關的行政、電訊、電腦、支付、追收欠款、信用參考或其他服務的任何中間人、承包商、或第三者服務提供人；
- 本公司的任何分行；
- 任何對公司有保密責任的人；包括對本公司有保密資料承諾同一集團公司；
- 任何和客戶已有或建議有交易的財務機構；及
- 任何本公司的實在或建議的受讓人，或本公司對客戶的權利的參與人或附屬參與人或受讓人。
根據條例中的規定，任何人：
- 有權審查本公是否持有其本人的資料及有權查閱有關的的資料;
- 有權要求本公司改正有關其本人不準確的資料；及
- 有權查悉本公司對於資料的政策及實務及被告知本公司持有的個人資料的種類。
根據條例中的規定，本公司有權就處理任何查閱資料的要求收取合理費用。
若客戶或客戶代理人提供錯誤或不確實資料，本公司毋須負責。
中、英文本如有任何歧異之處，皆以英文本為準。
任何有資料查閱或改正，或有關本公司對於資料的政策及實務或持有資料種類的查詢，應向下列人任提出:

Circular to Customers relating to the Personal Data (Privacy) Ordinance (the “Ordinance”)

From time to time, it is necessary for customers to supply the Company with data in connection with the opening or continuation of accounts and the establishment or continuation of credit facilities or provision of financial services.
Failure to supply such data may result in the Company being unable to open or continue accounts or establish or continue credit facilities or provide financial services.
It is also the case that data are collected from customers in the ordinary course of the continuation of the business relationship.
The purposes for which data relating to a customer may be used are as follows:
- the daily operation of the financial services and credit facilities provided to customers;
- conducting credit checks;
- assisting other financial institutions to conduct credit checks;
- ensuring ongoing credit worthiness of customers;
- designing financial services to related products for customers’ use;
- marketing financial services or related products;
- determining the amount of indebtedness owed to or by customers;
- collection of amounts outstanding from customers and those providing security for customers’ obligations;
- meeting the requirements to make disclosure under the requirements of any law binding on the Company; and
- purposes relating thereto.
Data held by the Company relating to a customers will be kept confidential but the Company may provide such information to the following parties within or outside of Hong Kong to the extent permitted by law.
- any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment, debt collection, credit reference or other services to the Company in connection with the operation of its business;
- any other branch of the Company;
- any other person under a duty of confidentiality to the Company including a group company of the Company which has undertaken to keep such information confidential;
- any financial institution with which the customer has or proposes to have dealings; and
- any actual or proposed assignee of the Company or participant or sub-participant or transferee of the Company’s rights in respect of the customer.
Under and in accordance with the terms of the Ordinance, any individual:
- has the right to check whether the Company holds data about him and the right of access to such data;
- has the right to require the Company to correct any data relating to him which are inaccurate; and
- has the right to ascertain the Company’s policies and practices in relation to data and to be informer of the kind of personal data held by the Company.
In accordance with the terms of the Ordinance, the Company has the right to charge a reasonable fee for the processing of any data access request.
The Company shall not have any liability to the customers if any information supplied by the customers or on the customers’ behalf is incorrect or inaccurate.
In the event of an inconsistency between the English and Chinese versions of this Circular, the English language version shall prevail.
